THE FORECLOSURE DEFENSE SYSTEM is an intensive two-day training course for attorneys to get armed with a systematic approach to fighting foreclosure actions.

The course covers the law, including statutes, regulations, rules and legal doctrines relating to formation and enforcement of contracts, negotiable instruments, the U.C.C., transactional evidence, mortgage transaction regulation and consumer protection.

Specific defenses to mortgage foreclosure actions are discussed with examples of how Florida and other courts are now currently addressing the legal issues.  Course materials contain over 30 foreclosure defenses with citations to case law and other authority.  Special attention is given to defenses relating to mortgage backed securities using charts and other visuals to make this complex content easier to understand and follow.

Participants learn about the 10 Stages of Foreclosure Homeowner Distress, developed by CASECLARITY, which provides insight to transactional, servicing and enforcement abuses that form the basis of real defenses and affirmative claims for homeowners facing foreclosure.  Mind maps are used to demonstrate the litigation spectrum so that the attorney can learn the specific advocacy required at each stage of representation.  Each law office represented receives poster-size charts showing the 10 stages for use in their in their practice.  Past attendees report great success using these charts with prospective clients.
