CASECLARITY offers consumer law attorneys training, litigation support, technologies and insight on best practices for assisting clients with defense to foreclosure and debt collection actions. Unlike paralegal service providers, CASECLARITY brings law firms a much wider array of capabilities, resources and services designed to win cases. We teach attorneys an entirely new way of approaching cases applying innovative methods for discovering facts to support defenses or claims; tools to strengthen arguments and presentations; and exploring solid legal arguments that track specific litigation paths.
CASECLARITY fulfills a very special and unique role in the emerging area foreclosure defense. Our company is quite different than the majority of current service providers generally falling into categories of loan modification services; loan transaction audits (sometimes referred to as forensic audits); short-sale/short-pay consulting and negotiators and companies providing paralegal services; or consultants and expert witnesses assisting attorneys within very specific areas of consumer law, such as Truth-in-Lending Act violations or securtization.
CASECLARITY does not directly compete with any of these types of companies. Rather, as can be seen from the services described on this website, our focus is on:
- assisting counsel to better understand the wider and real range of opportunities for representation, defense fact-finding and practively shaping the the litigation – even in a defensive context;
- providing training, knowledge, insight and perspective to bring clarity to the emerging area of foreclosure defense;
- introducing law firms to procedures, workflows and methods that move these cases along a more predictable and manageable path/litigation track; and
- arming counsel with software, systems and other tools, along with very specific litigation support services to win cases.
Caveat Emptor. The mortgage foreclosure crisis has brought in many entities into the fray with each claiming to assist homeowners in distress. Some of these entities have come with ulterior motives. This is seen with scam artists whose services range from mortgage brokers, loan modification companies and consultants, forensic loan auditors, foreclosure prevention consultants, real estate investors and speculators – and the list goes on. An increasing number of these operators have fallen under the strong hand of the regulatory agencies because the services actually harmed consumers. Neither CASECLARITY nor any of its principals has never engaged in any of these types of operations. Nor have we been subject of any investigation or disciplinary action by regulators – or anyone else.
CASECLARITY is not a law firm and does not engage in the practice of law in any jurisdiction. We do not give legal advice or represent anyone in court. CASECLARITY does not provide “foreclosure rescue” services.
The focus of our work, by design, has been to work only with attorneys and their organizations. CASECLARITY has a firm understanding of the range of services an attorney may outsource, as authorized by the American Bar Association and the relevant state Bar Associations. Our goal is to assist our attorney clients within the etablished ethical, professional and legal boundaries. Any of the lawyers we have worked with over the years will readily tell you how conservative view we hold and live by in this regard. We believe it is extremely important that attorneys operating in the consumer law space, especially at this time of crisis, be very mindful of the entities with whom they seek to obtain outside services.
